- Acceptance of these terms applies specifically to the service you are subscribed to and not across all services.
- You agree to limit Allsorts Hosting’s liability and indemnify Allsorts Hosting for certain actions or omissions.
2. Definitions
- “Allsorts Hosting” refers to Allsorts Web Designers or any entity to which Allsorts Web Designers may assign its rights or obligations.
- “Client” refers to the individual or organization on record as a subscriber to an Allsorts Hosting service.
- “Domain” signifies an Internet domain registered through an accredited registrar, including domain name server records such as host names and MX records.
- “Supplier” represents any provider of goods and/or services to Allsorts Hosting.
3. Client Obligations
- The client confirms the accuracy of the information provided to Allsorts Hosting. Allsorts Hosting reserves the right to request additional information for verification purposes.
- Allsorts Hosting may request verification of the primary account holder’s identity, and failure to provide this may result in account suspension or termination.
- Allsorts Hosting enforces acceptable use policies for its platform and reserves the right to suspend or terminate accounts that violate these policies.
- Allsorts Hosting may remove client-hosted content deemed illegal, offensive, or otherwise inappropriate.
4. Service Availability
- While Allsorts Hosting aims to provide consistent service, availability is not guaranteed and may be affected by factors beyond its control.
- Downtime resulting from misconfiguration or data loss by the client is not the responsibility of Allsorts Hosting.
- Allsorts Hosting may discontinue any service deemed unfeasible or inappropriate.
5. Payment Terms
- Allsorts Hosting is not liable for delays or issues due to non-standard payment methods.
- Services may be suspended if fees remain unpaid past the due date.
- Accepted payment methods include PayFast and Stripe. Direct EFT/Bank transfer payments are not accepted.
- Stripe-stored credit card details may be used for automatic payment of future invoices, with details removable on request.
7. Term and Termination
- Allsorts Hosting operates on a month-to-month basis. Clients may terminate services via the client portal or by written notice.
- The client is responsible for properly following the cancellation process to avoid additional charges or penalties.
8. Client Information and Privacy
- The primary account holder is recognized as “the client,” with no third-party access permitted without the client’s authorization.
- Allsorts Hosting complies with applicable privacy laws, including the Protection of Personal Information Act (POPIA) of 2013.
9. Security
- Allsorts Hosting has implemented industry-standard security measures but cannot guarantee against security breaches.
- Clients are responsible for ensuring that no malicious software compromises the Allsorts Hosting platform.
10. Domain Registration
- Domains are registered through appropriate governing bodies, with these terms applying to related services offered by Allsorts Hosting.
- Allsorts Hosting is not liable for delays in domain registration and renewal; clients should ensure accurate domain registration information and monitor auto-renewal settings.
11. Domain Transfer
- Allsorts Hosting transfers domains from other providers as requested. Clients must ensure they have the authority to initiate transfers and indemnify Allsorts Hosting from any ownership disputes.
12. Cancellation Policy
- Cancellation results in the permanent deletion of data from Allsorts Hosting’s servers, and clients are responsible for their own data backups.
- Pro-rata refunds are not available for monthly services canceled mid-month, and refunds for annual plans are subject to specific conditions and calculations.
13. Domain Registrant Contact Details
- The client must ensure accurate information on domain registration records for legal compliance.
14. Hosting Services
- Allsorts Hosting may refuse to host or register certain clients’ domains and websites.
- The client must respond to any potential denial-of-service attacks (DDoS) affecting the platform.
15. Backups
- Clients are responsible for creating backups of all hosted data, and Allsorts Hosting is not liable for data loss or backup failure.
16. Email and SPAM
- Allsorts Hosting’s spam and virus filters may inadvertently classify legitimate emails as spam or viruses. The client acknowledges the possibility of such occurrences and agrees that Allsorts Hosting is not liable for resulting data loss.
17. Retention of Rights
- Allsorts Hosting retains all ownership of equipment while clients hold intellectual property rights over their hosted data.
18. Software Updates
- Allsorts Hosting ensures its operating system software is up-to-date; however, clients are responsible for updating any specific software they use, like WordPress or other CMS tools.
19. Affiliates
- Allsorts Hosting reserves the right to review and potentially terminate affiliate relationships deemed inappropriate.
20. Complaints and Appeals
- For service-related complaints, clients may contact support via Allsorts Hosting Support.
21. Domain Expiry
- Domains in the .uk namespace follow a renewal grace period procedure post-expiration, with renewal notices sent before expiration.
22. Limitation of Liability and Indemnity
- Allsorts Hosting’s liability for damages is limited and excludes certain types of losses. The client indemnifies Allsorts Hosting from claims or damages associated with the use or registration of domain names or hosting services.
23. Account Deletion Due to Prolonged Non-Payment
If payment is not received for a period of three consecutive months:
Notification: Allsorts Hosting will send a final notification to the registered email address before permanent deletion to allow the client one last opportunity to make payment and restore the account.
Account Suspension: The account will be suspended, and all services associated with it will be inaccessible until full payment is made.
Data Deletion: After three months of non-payment, the account, along with any data, files, and content stored on our servers, will be permanently deleted.
Irrecoverable Loss of Information: Once the account is deleted, all data associated with the account will be irretrievably lost, and Allsorts Hosting will not be responsible for retaining or recovering any information or files.
